Then this post is for you. Whether you are contemplating a divorce, in the middle of one, or post-divorce, you should be aware how social media can be used during the proceedings.
Attorneys are increasingly using social media posts during hearings, especially in domestic matters. You should never post about your family law case online. Additionally, you should be mindful what you post about your personal life. Privacy filters may not be enough to shield your posts.
You may choose to deactivate your social media profiles, but you should not delete any information, regardless of how damaging it is. Courts can impose sanctions for destroying evidence, including an inference that the posts were embarrassing or hurtful to your case
On the other hand, posts from your spouse or children may be helpful to your case. If you see something concerning, try to save that information, whether by downloading a picture or taking a screenshot of a post. You should also contact your attorney as soon as possible, before the information can be removed.
You should discuss any potentially embarrassing or damaging material on your social media profiles with your attorney. Your attorney will work with you to develop a strategy for mitigating any potential negative results.
