What Are "Unbundled" Services?

The most frequent question I am asked during an initial consultation is, “How much will this cost me?” Unfortunately, the answer can be as much as $25,000 or $30,000 for a contested divorce. While there are ways to keep costs down, quite a bit of this depends on the actions of the other party, which is out of the client’s control.

If you gasped at the figure in the last paragraph, you are not alone. Unfortunately, the cost of legal services is only increasing, which puts full representation out of reach for many clients. In 2014, the Colorado Access to Justice Commission estimated that almost 76% of family law litigants did not have an attorney.[1]

In response, many attorneys are now offering “unbundled” legal services, which tailors representation based on the individual’s budget. This allows the client to pick and choose the level of representation that is needed, and can dramatically reduce the cost. Examples of unbundled services include review of documents prepared by the client; coaching the client in preparation for a hearing; or review of and advice concerning a settlement agreement.

There are risks with unbundled services, since the client is still representing himself or herself. However, for individuals who could not otherwise afford to hire an attorney, unbundled services can provide access to the expertise of an attorney without breaking the bank.
